Terms and Conditions

Agreement
This agreement between Photography909 (the “Photographer”) and the undersigned client (the “Client”) or agency representative (the “Agency”) governs the project described in the accompanying Estimate. The Estimate and these Terms & Conditions together form the full agreement. The Client/Agency must ensure an authorised representative is present during the shoot; if not, the Photographer’s interpretation shall be deemed acceptable. Any changes may result in additional charges. Expenses are estimated in good faith, with a 10% variance. The Client/Agency indemnifies the Photographer against liabilities, claims, and expenses, including legal fees, arising from use of the work. Estimates are valid for 15 days.

Definitions
“Work”/“Images”: photographic materials created by the Photographer. Client: the licensee of the Work. Usage categories include Editorial, Publicity, Advertising, Collateral, Public Display, Private Display, POS, Packaging, Unlimited, Consumer, Trade, Print, Web, Electronic, OOH, and Broadcast.

Payment
A non-refundable £150 booking fee secures a shoot date. Balance payable within 30 days of invoice. Overdue payments incur interest at 4% above the Bank of England base rate. Travel, accommodation, subsistence, parking, and permits may be charged in addition. Travel beyond 50 miles from Wimborne is charged at £0.55/mile; central London congestion/parking applies. International travel, accommodation, and meals must be covered by the Client.

Copyright & Licensing
All copyright remains with Photography909. Usage rights are granted only upon full payment and are non-exclusive, non-transferable, and limited to agreed usage. Additional use (e.g., resale, advertising campaigns, wider distribution) requires a new licence and fee. Minimum licence fee: £120 per image. Corporate/manufacturer use may require extended licensing. Images cannot be modified or incorporated into derivative works without written permission. Unauthorised use is a copyright breach.

Credit
Photographer credit is required for editorial and publicity use: Online/social media – Photography: @photography909; Print/website – www.photography909.co.uk. Failure to credit will incur a 100% uplift to the licence fee.

Licensing After the Commission
Images cannot be reproduced without written permission. Third parties (contractors, partners, suppliers) must obtain their own licences. The Client must confirm intended usage to ensure correct licensing.

Cancellations, Weather, Postponements
Cancellation within one week of the shoot: up to 100% of fees (creative, licensing, and expenses). Cancellation after booking: liable for incurred expenses plus up to 50% of fees.

Weather postponements: Flexible Rebooking

“Weather-related postponements agreed at least one day prior to the shoot will be rescheduled at no additional charge. The Client will only be liable for expenses already incurred that cannot be refunded (such as travel or permits).”

Delivery & Post-Production
Delivery is within 7–15 working days depending on scope. Rush delivery may incur charges. Work is supplied as high-resolution digital files unless agreed otherwise. Standard post-production is included; additional retouching is charged case by case.

Force Majeure
Neither Photographer, Client, nor Agency shall be liable for failure to perform obligations caused by events beyond reasonable control (natural disasters, pandemics, riots, war, terrorism, energy failure).

Responsibilities
Client: arrange access, permissions, site safety compliance, and obtain any required model/property releases. Photographer: provide services with skill and care, maintain public liability/professional indemnity insurance, and hold a CSCS card for construction site access.

Archiving & Liability
Final images are retained for 12 months; long-term storage is the Client’s responsibility. Liability is limited to the total fee paid. The Photographer is not liable for indirect or consequential losses.

Governing Law
These Terms & Conditions are governed by the laws of England & Wales, with disputes subject to the exclusive jurisdiction of the English courts.
